There must be three conditions met for a product to fit the legal definition of Soap.
- Soap must be made mainly from “alkali salts of fatty acids.” The material must combine fats or oils with an alkali, such as lye.
- The combination of the material may be the only agent used for the products cleaning action.
- It can only be labeled and marketed for use as soap
A bar of soap is merely a shape of soap for convenient use by the consumer.
In the US, soap meeting the above three conditions used on a human body is exempt from the cosmetic definition and therefore, exempt from the regulations governing cosmetics.
In comparison, in some countries, including Canada and the Eurepon Union, any soap applied to humans must be considered a cosmetic and is regulated by the governing regulations.
That mean the difference between soap and everything else, is a function of legal definitions for regulation purposes. Plus it also means that soap is for cleaning and nothing else, or it would not be soap.
